Employees and Contractors
What is the difference between an employee and a contractor?

It turns on how much control you have over how the work is done, not on what the agreement is called. Employees receive a W-2 and have tax withheld; contractors receive a 1099-NEC and handle their own. Treating an employee as a contractor can result in back taxes and penalties, so it is worth confirming rather than assuming.

I am the only employee of my own S Corporation. Do I still need payroll?

Yes. An owner working in their own S Corporation must be paid reasonable compensation through payroll, with the associated withholding and filings. It is one of the obligations that comes with the S Corporation election, and one that is frequently overlooked.

Can you handle employees in more than one state?

Yes. Each state where you have employees generally requires its own registration, withholding and unemployment insurance filings. We set up and maintain each one, which matters increasingly now that remote staff often live somewhere other than the business.


Deadlines and Compliance
How often do payroll taxes have to be deposited?

The IRS assigns you a deposit schedule — commonly monthly or semi-weekly — based on your past payroll tax liability, and it can change from year to year. Missing a deposit date is one of the fastest ways to incur a penalty, which is why we manage the calendar rather than leaving it to memory.

When do employees receive their W-2s?

W-2s must reach employees near the end of January following the tax year, with copies filed with the Social Security Administration by the same point. The same timing applies to 1099-NEC forms for contractors. We prepare and distribute both.

What if I have already fallen behind on payroll filings?
